• You receive a limited, non-exclusive license to use the plans for a single construction project.
• You may not reproduce, distribute, display, or create derivative works of the plans except as necessary for the construction of a single home.
• You may provide the plans to builders, contractors, and local authorities as necessary for the construction project.
• You may not sell, rent, lease, sublicense, or otherwise transfer the plans to any third party.

13. Arbitration Agreement

The arbitration shall be conducted by one arbitrator appointed in accordance with the AAA rules. The place of arbitration shall be Boston, Massachusetts. The language of the arbitration shall be English.

You and US HomeForge agree that any arbitration shall be limited to the dispute between US HomeForge and you individually. To the full extent permitted by law:

• No arbitration shall be joined with any other proceeding
• There is no right or authority for any dispute to be arbitrated on a class-action basis or to utilize class action procedures
• There is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons

13.1 Exceptions to Arbitration

The following disputes are not subject to the above provisions concerning binding arbitration:

• Any dispute seeking to enforce or protect, or concerning the validity of, any of US HomeForge's intellectual property rights
• Any dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use
• Any claim for injunctive relief

If this provision is found to be illegal or unenforceable, then neither you nor US HomeForge will elect to arbitrate any dispute falling within that portion of this provision found to be illegal or unenforceable, and such dispute shall be decided by a court of competent jurisdiction within Suffolk County, Massachusetts.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by US HomeForge on our website, shall constitute the entire agreement between you and US HomeForge concerning our website and services.

16. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and US HomeForge's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
